Im Austausch wird der französische Staat eine Besserungsklausel auferlegen, die eine Rückzahlung an den französischen Staat von 23,5 % des laufenden konsolidierten Jahresergebnisses von Bull vor Steuern in einem Zeitraum von acht Jahren ab dem zum 31. Another consideration to be taken into account in the present case is the very high speed of technological developments in the relevant sector.

Außerdem handelt es sich — wie die Beschreibung der finanziellen Lage Alitalias seit 1997 belegt — um die gleiche Art von Schwierigkeiten wie sie das Unternehmen zuvor bereits hatte (siehe Erwägungsgründe 57 und 58), die sich im Gegensatz zur Sachlage des Falls Bull [53] mehrfach wiederholt haben. Am 13. November 2002 hatte die Kommission ein Verfahren nach Artikel 88 Absatz 2 EG-Vertrag wegen eines Liquiditätsvorschusses von 450 Mio. EUR des französischen Staates an das Unternehmen Bull mit einer befürwortenden Entscheidung (Entscheidung 2003/599/EG [2] unter der Voraussetzung eingestellt, dass die Beihilfe bis spätestens 17. Juni 2003 zurückgezahlt wird. On 13 November 2002, the procedure laid down in Article 88(2) of the Treaty opened in respect of a EUR 450 million cash advance granted by France to Bull was closed by the Commission by Decision 2003/599/EC [2] — a positive decision conditional on the aid being repaid by 17 June 2003.

Zur Beseitigung der Anfang der 90er Jahre aufgetretenen Schwierigkeiten führte Bull ab 1994 gemäß den von Frankreich eingegangenen Verpflichtungen die Maßnahmen eines früheren Umstrukturierungsplans durch, die die Kommission in ihrer Entscheidung 94/1073/EG vom 12.
