Bei dem Kontrollbesuch bei Graphite COVA, dem verbundenen Unternehmen in Deutschland, wurde jedoch deutlich, dass es sich bei dem Teil der Einfuhren aus Indien, die als künstliches Grafit angemeldet wurden, tatsächlich um Einfuhren von zweimal gebrannten Elektroden in Form von Kohlenstoffstäben handelte, die noch nicht grafitiert worden waren. However, on inspection of the related company in Germany, Graphite COVA, it became clear that the part of the imports from India declared as artificial graphite were in fact imports of re-baked electrodes in the form of rods of carbon which had not yet been through the process of graphitisation.
Ein Abgleich der von den beiden Unternehmen übermittelten Daten mit den bereits vorliegenden Angaben über die Einfuhren der untersuchten Ware ergab, dass die beiden Unternehmen, Graphite India Limited und HEG Limited, im UZ als einzige die untersuchte Ware in die Gemeinschaft ausführten. The information submitted by the two companies could be reconciled to the data available on the imports of the product under investigation so as to show that the two companies, Graphite India Limited and HEG Limited, were the sole exporters of the product under investigation to the Community during the IP.
Es sei darauf hingewiesen, dass dieses Unternehmen in der Ausgangsuntersuchung unter dem Namen Hindustan Electro Graphite Limited geführt wurde. It should be noted in this regard that in the original investigation the full, official name of that company was Hindustan Electro Graphite Limited.

Nach parallel geführten Antidumping- und Antisubventionsverfahren führte der Rat mit der Verordnung (EG) Nr. 1628/2004 [2] („ursprüngliche Verordnung“) auf die Einfuhren bestimmter Grafitelektrodensysteme mit Ursprung in Indien folgende endgültige Ausgleichszölle ein: 15,7 % für das Unternehmen Graphite India Limited, 7,0 % für das Unternehmen HEG Limited und 15,7 % für alle übrigen Unternehmen. Auf Antrag von Hindustan Electro Graphite Limited („HEG“ oder „Unternehmen“), einem den geltenden Antidumpingmaßnahmen unterliegenden ausführenden Hersteller in Indien, wurde eine teilweise Interimsüberprüfung der oben genannten Verordnung gemäß Artikel 11 Absatz 3 der Grundverordnung eingeleitet.
