The conditions of Società Terni’s preferential tariff were established in Articles 6, 7 and 8 of Presidential Decree No 1165/63 Transfer to Ente Nazionale per l’Energia Elettrica of the assets used for the activities mentioned in Article 1(1) of Law No 1643 of 6 December 1962 carried out by ‘Terni-società per l’Industria e l’Elettricità S.p.A.’	Die Konditionen für den ermäßigten Stromtarif, der den aus Terni hervorgegangenen Unternehmen gewährt wurde, sind in den Artikeln 6, 7 und 8 des Präsidentialerlasses Nr. 1165/63 mit der Bezeichnung „Trasferimento all'Ente Nazionale per l'Energia Elettrica dei complessi di beni organizzati destinati alle attività di cui al primo comma dell'art.
The preferential tariff scheme from which Alcoa benefits is provided for by the respective legislative provisions (2.2.1) and the detailed regulations laid down by the Authority for Electric Energy and Gas (Autorità per l’Energia Elettrica et il Gas — ‘AEEG’) (2.2.2.1). The present decision covers both the tariffs introduced by Article 1 of the 2004 Decree for beneficiaries other than Alcoa (‘the 2004 tariffs’) and those introduced by Article 11(12) of Law No 80/2005 and subsequently spelt out in decisions taken by the Electricity and Gas Authority (Autorità per l’Energia Elettrica e il Gas — ‘AEEG’) (‘the 2005 tariffs’).
