In Valmont, the CFI considered that the Commission should not have simply relied on the existence of an independent expert’s assessment to determine whether a sale of land involved the granting of State aid. In der Rechtssache Valmont vertrat das GEI die Auffassung, dass sich die Kommission bei ihrer Prüfung, ob bei dem Verkauf eines Grundstücks staatliche Beihilfen im Spiel waren, nicht einfach darauf hätte verlassen sollen, dass die Beurteilung eines unabhängige Sachverständigen vorliegt.
