Ist jedoch das nach Artikel 16 anzuwendende Recht das eines Nichtvertragsstaats und verweist das Kollisionsrecht dieses Staates auf das Recht eines anderen Nichtvertragsstaats, der sein eigenes Recht anwenden würde, so ist das Recht dieses anderen Staates anzuwenden.
